Supreme Court: state of Vermont can be sued for lack of oversight in Jay Peak EB-5 fraud

Despite the state of Vermont’s argument that it is immune to liability, the high court has allowed two of 13 claims, negligence and breach of contract, to go forward. The plaintiffs allege the state maintained no oversight in the biggest EB-5 fraud case of all time, where $200 million of investor capital was misappropriated.
