The October 2024 Visa Bulletin brings welcome news as it shows significant advancement for both China and India in the Unreserved categories. For new investors, the reserved categories remain “current” for all countries.
In Chart A, which determines when EB-5 investors may receive visas, China advances seven months in the unreserved category, from December 15, 2015, to July 15, 2016.
India advances 13 months in the unreserved category, from December 1, 2020, to January 1, 2022.
Date For Filing: China retrogresses 3 months
Chart B, the Date For Filing, shows China retrogressing three months from January 1, 2017, to October 1, 2016.
India has no movement in Chart B and remains at April 1, 2022.

The October 2024 Visa Bulletin has good news for new EB-5 investors as the set-aside categories remain current for all countries.
New EB-5 investors from all countries, including China and India, can concurrently file adjustment of status applications for the immediate future.
How the Visa Bulletin works: Final Action Date vs. Date For Filing
The date USCIS or a consulate receives an EB-5 investor’s I-526 petition is that investor’s priority date.
The Visa Bulletin has two dates: Chart A, the Final Action Date, and Chart B, Date For Filing. Investors who have a priority date on or before the Final Action Date have an available visa. Investors with priority dates on or before the Date For Filing may file their visa application before a visa is available.
