Is USCIS ‘making up’ processing time estimates to deter lawsuits and influence behaviour?

Looking at inventory data, anecdotal evidence and previous reports, EB-5 expert Suzanne Lazicki disputes the agency’s latest I-526 time processing range. She surmises “USCIS has started just making up numbers to protect themselves against lawsuits.” She thinks the reports are “a lever to influence community behaviour, not a report of facts.” For example, the recent USCIS estimated processing range for I-924’s was 4 – 8 years — but it’s now just 1-3 years. Lazicki views this change as a way to encourage demand for the highest revenue form.
