Immigration lawyer Bernard Wolfsdorf says the biggest issue in EB-5 today is visa availability. He expects the “rollover” of family-based visas to nearly double the total for EB-5 the next fiscal year; however, most will go to China. “We need a solution that resolves backlog issues for China and Vietnam.” Wolfsdorf seems to suggest an increase in the EB-5 quota. A common rallying cry in the industry has been to stop counting investor family members against the yearly quota.
