On July 11, the Immigration Service made changes to its EB-5 Q&A webpage, removing all language about “repealed” regional centers. Curiously, the title of the Q&A page still says “updated April 2022” — is USCIS trying to act as if its language about repealing regional centers never happened? And could the changes indicate the Immigration Service will concede its position in the legal battle over regional center deauthorization? We can’t be sure, but USCIS could have said it was following a temporary legal order if it wanted to indicate that the fight against deauthorization was not yet over.
