A lawsuit is trying to compel the U.S. State Department to “allocate” over 11,000 visas that are available for Chinese investors in fiscal year 2022 — but would otherwise be wasted. The plaintiffs, who have approved petitions, argue that their children are “aging out," and that the prolonged time for their investment capital to be deployed is unfair. In FY 2021, about 18,000 EB-5 visas were wasted.
