Judge denies request by Quiros adviser Kelly to sever EB-5 fraud trial from CEO Stenger

William Kelly, in-house attorney and adviser of Jay Peak fraud mastermind Ariel Quiros, lost his bid to separate his trial from that of former Jay Peak CEO William Stenger. Kelly’s request cited an email from Stenger’s lawyer stating that Stenger’s argument would be that Quiros and Kelly acted together to defraud investors and keep Stenger in the dark. While Kelly’s team believes such an “antagonistic” defense warrants a severance, the judge decided otherwise, saying “testimony about not knowing things does not create the conflict among defendants.”Law360 article (subscription required)
