EB-5 expert Suzanne Lazicki has written an open letter to Kevin Muck, the I-526 Division Chief at IPO. In the latest engagement, Muck responded to a question about I-526E receipt data by country and said to check the Visa Bulletin as it shows all reserved categories as “current.” Lazicki calls Muck’s comment “ignorant and dangerous” as backlogs exist long before they show up in the Bulletin. For example, in the December 2020 Bulletin India was “current,” but an Indian who filed then would be waiting today as India is now officially backlogged to June 2018. Lazicki says investors need current receipt data by country, at least quarterly, to understand potential wait times.
