The American Immigrant Investor Alliance (AIIA) has filed a second Freedom of Information Act (FOIA) against the USCIS seeking documents related to the “arbitrary” denials of Vietnamese EB-5 investors who use currency swaps. The group says these denials are disproportionately high compared with investors from other countries and wants clear guidance from USCIS regarding currency swaps as a legal path of funds. The AIIA says it is “unacceptable” for USCIS to hide adjudication policies from the public.
