EB-5 regional center annual statements - ongoing reporting requirements
As per the EB-5 Reform and Integrity Act of 2022 (RIA), approved regional centers fulfill and maintain ongoing reporting requirements, primarily in the form of a regional center annual statement I-956G, to provide the required information, certifications, and proof of continued eligibility for regional center designation.
This includes certification, after a due diligence investigation, that the regional center is in compliance with the bona fides requirements of the RIA, securities compliance, and direct and third-party promoter regulations.
The statement also included a description of any pending material litigation or bankruptcy proceedings, as well as an accounting of all EB-5 investor capital and fees in the regional center, and evidence of compliance with federal labor laws.
Annual-statement violations have a graduated set of sanctions including temporary suspension from the program and permanent debarment.
Annual statements can be requested by EB-5 investors and must be provided within 30 days of a request.
