The Vermont Supreme Court missed an opportunity to challenge a records exemption that allowed the state to withhold information about the involvement of government officials in the Jay Peak scandal. VTDigger, a news organization, and its parent organization had filed a lawsuit seeking to narrow the exemption, arguing it violated the First Amendment rights of the press. The exemption allows the state to keep records related to ongoing legal action confidential. The court declared the case moot, stating that the plaintiffs had already obtained the documents they sought. The VTDigger editor calls the decision “an affront to transparency, and shows just how hard it can be for the public to get answers — even when the questions are about the largest fraud in state history.”
