Oppenheim sees reserved categories staying ‘current’ on Visa Bulletin till mid-2024, talks Vietnam and pre-RIA rural projects
In the latest WR Immigration Chatting With Charlie webinar, Charlie Oppenheim speculates that the set-aside categories will not have final action dates till at least May 2024. He is also “a little confused” why Vietnam is still “current” on the Visa Bulletin as recent data shows more approved Vietnamese applicants than Indians. When asked if a pre-Reform Act (RIA) rural project could qualify for the reserved set-asides, he says the answer could be yes, but “the petition may need to be re-adjudicated in that rural set-aside.” Immigration lawyer Joey Barnett says USCIS opposes pre-RIA investors qualifying for set-asides, but pre-RIA investors could potentially refile and invest more money as per the RIA.
