Chinese EB-5 investors are making a second attempt to enforce a settlement to recover loans they provided to Florida shopping mall developer Nicholas Mastroianni. The investors initially filed a motion in 2020, alleging Mastroianni misused their funds instead of repaying them with interest. While a settlement was reached in July 2022, Mastroianni's proposed amendments, such as excluding himself from the settlement and altering the payment structure, were rejected by the investors. Now, the investors have resubmitted the motion, seeking $335,000 for each participant in the class action.
