Form I-485: Adjustment of Status requirements

Form I-485, Application to Register Permanent Residence or Adjust Status, is the form used by EB-5 petitioners who are already in the United States and have an eligible visa number. This form may be filed concurrently with an I-526 or I-526E petition.

The filing fee is $1,140 for most petitioners; for petitioners under 14 years of age who are filing with at least one parent, the fee is $750. Petitioners between the ages of 14 and 78 also must pay a biometrics fee of $85.

Petitioners who file an I-485 application can also file an I-765 Application for Employment Authorization and I-131 Application for Travel Documents.

Upon the approval of the I-485, petitioners will be issued Green Card for a two-year conditional permanent residency.
