Contribute $800,000 - $1,050,000 to a qualified EB-5 project.
With your lawyer's assistance, submit Form I-526E to USCIS (US Citizenship and Immigration Services).
Following I-526E approval, you and your family are eligible for conditional Green Card.
Applicants outside of US must go through consular processing. Applicants in US adjust status.
After Form I-829 approval, conditions are removed from permanent residency. You and your family are eligible for citizenship in five years.
The EB-5 timeline involves two key considerations:
The I-526E petition processing time varies depending on the project's type and location. Rural petitions take 3 months to 1 year for approval. Petitions for projects in other locations may take 2 years or more.
Investors from most countries will have a visa available for permanent residency immediately upon I-526E petition approval. Investors from backlogged countries (China, India, and Vietnam) who don’t have reserved visas may have to wait several years. However, investments in rural, high-unemployment, or infrastructure projects offer reserved visas that may be immediately available to anyone.
Use our I-526E Processing Estimator to learn how long your application might take to be processed.
Go to ToolWhile the investment being “at risk” is a program requirement, thorough due diligence can help an investor feel he or she has made the safest EB-5 investment possible.
An EB-5 immigration lawyer can help understand the likelihood of immigration success for a project. However, lawyers are not qualified to advise on the financial risks of an EB-5 investment; thus, an investor should work with an experienced EB-5 financial professional to assess the likelihood of a full and timely return of investment capital.
The EB-5 Green Card By investment program offers a minimum of 10,000 visas per year, including family members.
Each year 32% of visas are reserved: rural 20%, high-unemployment 10%, and infrastructure 2%.
Set-aside visas are immediately available for investors from any country. Rural investments have priority processing.
