Q: How do I start the process as I am still in my home country?

There are 4 steps to start the process. Step 1. Interview immigration lawyers who are expert at EB-5. If you want some references, just ask us. Your immigration lawyer should start by helping you determine whether EB-5 is the right immigration path for you and your family. Step 2. Review investments that qualify for EB-5. Use the Investments page on this site. Step 3. Complete an investor form which is required before viewing investments. Step 4. An investment professional will schedule a call with you to discuss your situation and share due diligence information on each of the investments you like.

Q: When do I need to make my investment?

An EB-5 investment must be made prior to filing your EB-5 application (FORM I-526). A receipt of your investment will be included in your application. If your immigration lawyer has all the information needed to file your I-526, then as soon as the investment is made, your petition can be filed.

Q: When do I need to transfer my investment amount?

EB-5 capital or your investment amount, will typically be required once you have selected an investment, reviewed the offering documents and signed the Subscription Agreement. The Subscription Agreement is the document that represents your acceptance into the partnership, you become a limited partner or a member of a Limited Liability Company (LLC). Your investment funds are typically wired into an escrow account, which provides a temporary account for your funds (not yet in the control of the Manager) until you file your I-526. The escrow account will typically transfer your funds to the Manager\'s account upon filing your I-526.

Q: What is the total cost of EB-5?

In today\'s environment I would budget $1m for the EB-5 petition and the required investment. The minimum investment amount is currently $900,000 if located in a high unemployment or rural area, though these are readily available in today\'s market. The investment should have a rate of return commensurate with the risk, but will not usually offer market rates as EB-5 program costs and risks are high to the developer. Investments will probably last 5-7 years.Other costs include an immigration lawyer ($15,000-$25,000), administration fees paid to the Manager of the investment (sometimes referred to as the issuer) of ($60,000-$90,000) and filing fees of under $5,000.

Q: What is the best location to invest in?

Now that invests must actually be in targeted employment areas (TEAs) or rural areas to qualify for a $900,000 investment amount, selecting an investment by location or region is an extremely deficient way of selecting an EB-5 investment. You might ask the person helping you analyze investments if they have good investment options near an area you plan to live, or near an area that you think has tremendous growth potential, but I would caution you to spend the majority of your time evaluating investment terms before investing.

Q: What industry is safest to invest in?

The EB-5 industry is currently going through significant changes and this is changing the investment landscape of the program. Previously most EB-5 investments were made in businesses located in major cities where demand was high. Investors were being offered rates of return of around 0.5%. As I mentioned, things are changing. Investments in urban areas that aren\'t considered \'high unemployment areas\' require an investment of $1,8m instead of the $900,000 minimum investment made in other areas. On EB5Marketplace.com you can view investments currently available in the market, which now include commercial real estate, resort locations and even technology companies. This is a complicated time to find successful new commercial enterprises and my suggestion is to work with an experienced EB-5 broker to get some guidance so you can make an informed investment decision.

How can I get an EB5 visa?

An EB-5 visa requires an investment into a new commercial enterprise (NCE) and the investment must contribute to the creation of 10 or more jobs for US residents. Other requirements include that the investment be a minimum of $900,000 USD and the investment must remain at risk for the duration of the sustainment period. Investors typically hire an immigration lawyer with substantial EB-5 experience and an investment broker to help them identify and select an investment.

Q: How long will my I-526 processing time be?

It depends on which country you were born in. When you register on this website, you will be asked to enter your country of birth. We can then give you a better idea of the likely approval date range of your I-526.
