If the developer of the project you invested in gets criminally charged, you may find that USCIS takes a pronounced interest in all the petitions filed in that project. It is not a rule or regulation that will effect your application but USCIS adjudicators may slow down the approval process until they are sure that all jobs have been effectively created and that no investor funds were prevented from getting to the job creating entity. If the Immigration Service determines that even $1 of an investor's funds were not contributed to creating jobs, the Service could deny the petition on the grounds that the minimum investment amount of $900,000 or $1,800,000 was not met, even if the amount accepted by the Service is $899,999.
